A community majority cannot stop an unwanted corporate
project or activity because…
a. the state does not recognize local communities’ right to
self-government
b. the corporation can sue based on discrimination and
foregone profit per the 14th amendment (the one that gave personhood
to black people after the Civil War)
c. if the corporate activity is currently regulated by the state
or federal government, then local decisions to control that harmful activity
are considered barriers to interstate trade under the Commerce Clause of the
Constitution as interpreted by the U.S. Supreme Court for over 100 years
d. All of the above
d. All of the above (however, over 150
communities, including the city of Pittsburg and Mora County, N.M., have kept
unwanted corporate activity out by
passing a rights-based ordinance that elevates community rights over
corporate privilege, denies corporate personhood, and recognizes the right of
nature and its ecoystems to exist and flourish.)
